Welcome to Dopafy (www.dopafy.app). These Terms of Service (“Terms”) govern your access to and use of the Dopafy mobile application (“App”) and related services. By downloading, installing, or using Dopafy, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Dopafy is operated by Alexander Alber (Einzelunternehmer), Toemlingerstr. 21, 81375 Muenchen, Germany (“we”, “us”, “our”).

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. Description of Service

Dopafy is an AI-powered health and routine planning application for iOS. The App provides:

• Personalized daily and weekly routines based on a comprehensive onboarding questionnaire
• AI-generated meal suggestions and workout routines tailored to your goals, preferences, and available equipment
• Dopamine score tracking, streak monitoring, and gamified progress systems
• Bad habit check-ins, gratitude journaling, and weekly reflections
• Smart notifications and calendar integration
• Detailed statistics and achievement tracking

The App is designed as a wellness and lifestyle tool. It is not a medical device, and the content provided should not be considered medical, nutritional, or professional health advice.

3. Account Registration

To use Dopafy, you must create an account using Apple Sign-In. By registering, you agree to:

• Provide accurate and complete information during the registration process
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

4. Subscriptions & Payments

Dopafy is a paid subscription service. Access to the App’s features requires an active subscription. We offer the following plans:

• Monthly Subscription: $4.99 per month (includes a 1-week free trial for new subscribers)
• Yearly Subscription: $29.99 per year

Payment Processing

All payments are processed through the Apple App Store via in-app purchases. We do not directly collect or store payment information. All billing, payment processing, and transaction records are managed by Apple in accordance with their terms and policies.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Upon cancellation:

• You will retain access to the App until the end of your current billing period
• No refund will be issued for the remaining time in the current billing period
• Your data will be retained for a reasonable period in case you choose to resubscribe

Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing cycle. You will be notified in advance of any price increases through the App Store.

5. Free Trial

New subscribers to the monthly plan are eligible for a 7-day free trial. The free trial provides full access to all App features.

• The free trial begins when you subscribe to the monthly plan for the first time
• If you do not cancel before the trial period ends, your subscription will automatically convert to a paid monthly subscription at $4.99/month
• Each Apple ID is eligible for one free trial only
• You may cancel the trial at any time through your Apple ID account settings

6. User Content & Data

When using Dopafy, you may provide personal information, preferences, and other content through the onboarding questionnaire, habit tracking, gratitude entries, and weekly reflections (“User Content”). You retain ownership of your User Content.

By submitting User Content, you grant us a limited, non-exclusive license to use, process, and store this data solely for the purpose of providing and improving the App’s services, including generating your personalized plans.

7. AI-Generated Content Disclaimer

Dopafy uses artificial intelligence to generate personalized plans, including meal suggestions, workout routines, and daily schedules. Please be aware of the following:

• Not professional advice: AI-generated plans are suggestions only and do not constitute medical, nutritional, fitness, or any other form of professional advice
• No guarantee of accuracy: While we strive to provide helpful and relevant suggestions, AI-generated content may contain errors, inaccuracies, or recommendations that may not be suitable for your specific health conditions
• Consult professionals: Before starting any new diet, exercise program, or making significant lifestyle changes, you should consult with qualified healthcare professionals, especially if you have pre-existing medical conditions, allergies, or dietary restrictions
• Use at your own risk: You acknowledge that you follow AI-generated plans at your own discretion and risk
• Allergies and dietary needs: While the App considers your stated preferences, it is your responsibility to verify that suggested meals are safe for you, particularly regarding food allergies and intolerances

8. Intellectual Property

The Dopafy App, including its design, code, features, content, logos, and trademarks, is the intellectual property of Alexander Alber and is protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App’s content or branding for commercial purposes without prior written consent
• Create derivative works based on the App
• Use automated tools, bots, or scrapers to access the App or its content

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the App will be uninterrupted, error-free, or completely secure
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury arising from your use of the App
• Our total aggregate liability for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid for the App in the twelve (12) months preceding the claim
• We are not responsible for any health outcomes, injuries, or adverse effects resulting from following AI-generated plans or suggestions provided by the App

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct that may harm other users or the integrity of the service
• Extended periods of inactivity

You may terminate your account at any time by cancelling your subscription and contacting us at info@inzpyre.me to request account deletion. Upon termination, your right to use the App ceases immediately, though certain provisions of these Terms (including Limitation of Liability, Intellectual Property, and Governing Law) will survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For consumers residing in the European Union, nothing in these Terms shall affect your rights under mandatory consumer protection laws of your country of residence, including but not limited to the EU Consumer Rights Directive and the General Data Protection Regulation (GDPR).

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Munich, Germany, except where mandatory consumer protection laws provide otherwise.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Last updated” date at the top of this page
• Notify you through the App or via email where appropriate
• Provide a reasonable notice period before changes take effect

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the App and cancel your subscription.
