1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Dopafy is an AI-powered habit and routine planning application for iOS. The App provides:

• Personalized daily and weekly routines based on a comprehensive onboarding questionnaire
• AI-powered analysis of your routines, well-being signals, and energy patterns, with personalized recommendations
• Smart notifications and routine reminders, including streak warnings and daily summaries
• Goal tracking, streak monitoring, score tracking, and detailed progress statistics
• Weekly well-being and energy reflections, monthly career and job-satisfaction check-ins, and bad-habit tracking
• Screen Time monitoring and configurable app and screen blocking via Apple's Screen Time framework
• Apple Health and Apple Calendar integration

The App is designed as a wellness and lifestyle tool. It is not a medical device, and the content provided should not be considered medical, psychological, or professional health advice.

3. Account Registration

To use Dopafy, you must create an account using Apple Sign-In. By registering, you agree to:

• Provide accurate and complete information during the registration process
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Subscriptions & Payments

Dopafy is a paid service. Access to the App's features requires an active subscription or a one-time Lifetime purchase. We offer the following plans:

• Monthly Subscription: €4.99 per month, auto-renewing
• Yearly Subscription: €29.99 per year, auto-renewing
• Lifetime Access: €299 one-time payment, no recurring charges

Prices shown in the App are the authoritative prices for your region and may vary based on Apple App Store currency conversion and local taxes.

Payment processing: All payments are processed through the Apple App Store via in-app purchases. We do not directly collect or store payment information; all billing is managed by Apple in accordance with their terms.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple ID account settings. You will retain access until the end of your current billing period; no refund is issued for the remaining time.

Price changes: We reserve the right to change subscription prices. Any price changes take effect at the start of your next billing cycle and will be communicated in advance through the App Store.

5. Free Trial Offers

New subscribers are eligible for the following introductory free trial periods, subject to Apple App Store policies: Monthly Subscription — 7-day free trial, Yearly Subscription — 7-day free trial.

The exact trial offer available to you, if any, is displayed inside the App at the point of subscription. You will have full access to all App features during the trial period. If you do not cancel before the trial ends, your subscription automatically converts to the corresponding paid plan at the displayed price. Each Apple ID is eligible for one free trial per subscription group. You may cancel the trial at any time through your Apple ID account settings without further charge.

6. User Content & Data

When using Dopafy, you may provide personal information, preferences, and other content through the onboarding questionnaire, habit tracking, gratitude entries, and weekly reflections ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant us a limited, non-exclusive license to use, process, and store this data solely for the purpose of providing and improving the App's services, including generating your personalized plans.

7. AI-Generated Content Disclaimer

Dopafy uses artificial intelligence to generate personalized daily and weekly routines and to analyze your routines, well-being signals, and energy patterns in order to provide tailored recommendations. Please be aware of the following:

• Not professional advice: AI-generated routines, analyses, and recommendations are suggestions only and do not constitute medical, psychological, therapeutic, or any other form of professional advice
• No guarantee of accuracy: AI-generated output may contain errors, inaccuracies, or recommendations that may not be suitable for your specific situation or health condition
• Consult professionals: Before making significant lifestyle changes, or if you have pre-existing medical or mental-health conditions, you should consult with qualified healthcare professionals
• Use at your own risk: You acknowledge that you follow AI-generated routines and recommendations at your own discretion and risk
• Individual responsibility: It is your responsibility to ensure that the routines and recommendations are appropriate for your personal circumstances

8. Intellectual Property

The Dopafy App, including its design, code, features, content, logos, and trademarks, is the intellectual property of Alexander Alber and is protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App's content or branding for commercial purposes without prior written consent
• Create derivative works based on the App
• Use automated tools, bots, or scrapers to access the App or its content

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided on an "as is" and "as available" basis without warranties of any kind
• We do not warrant that the App will be uninterrupted, error-free, or completely secure
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury arising from your use of the App
• Our total aggregate liability for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid for the App in the twelve (12) months preceding the claim
• We are not responsible for any health outcomes, injuries, or adverse effects resulting from following AI-generated plans or suggestions provided by the App

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct that may harm other users or the integrity of the service
• Extended periods of inactivity

You may terminate your account at any time by cancelling your subscription and contacting us at info@inzpyre.me to request account deletion. Upon termination, your right to use the App ceases immediately, though certain provisions (including Limitation of Liability, Intellectual Property, and Governing Law) will survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For consumers residing in the European Union, nothing in these Terms shall affect your rights under mandatory consumer protection laws of your country of residence, including the EU Consumer Rights Directive and the General Data Protection Regulation (GDPR).

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Munich, Germany, except where mandatory consumer protection laws provide otherwise.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you through the App or via email where appropriate
• Provide a reasonable notice period before changes take effect

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the App and cancel your subscription.
